By accessing our website, purchasing a trail pack, or participating in a guided morning walk, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Definitions
In these Terms of Use:
- "Services" means all morning walk group experiences, guided dawn routes, trail packs, route briefings, community events, and related offerings provided by Detoxvivoneck
- "Trail Pack" means any purchasable pass including the Sunrise Starter Pass, Coastal Circuit Bundle, or Annual Dawn Membership
- "Walker" means any individual who registers for or participates in a morning walk group organised by us
- "Guide" means a Detoxvivoneck-appointed route leader responsible for conducting a scheduled walk
- "Website" means detoxvivoneck.world and all associated pages
2. Eligibility
You must be at least sixteen years of age to purchase a trail pack or participate in a morning walk group independently. Individuals under sixteen may participate only when accompanied by a parent or legal guardian who accepts these terms on their behalf. By using our services, you represent that you meet these eligibility requirements and that all information you provide is accurate and complete.
3. Website Use
You may use detoxvivoneck.world for lawful purposes related to learning about and booking our morning walk group services. You agree not to:
- Use the website in any way that violates applicable local, state, or federal laws
- Attempt to gain unauthorised access to our systems, servers, or databases
- Transmit viruses, malware, or other harmful code through the website
- Scrape, copy, or reproduce website content for commercial purposes without our written permission
- Impersonate any person or entity or misrepresent your affiliation with Detoxvivoneck
- Interfere with other users' ability to access or use the website
We reserve the right to suspend or terminate your access to the website if you breach these terms.
4. Trail Pack Purchases
4.1 Product Descriptions
We strive to ensure that all trail pack descriptions, pricing, and route information on detoxvivoneck.world are accurate. However, we do not warrant that product descriptions or other content are error-free, complete, or current. Prices are listed in Australian dollars and may change without notice. The price applicable to your purchase is the price displayed at the time of booking confirmation.
4.2 Payment
Payment for trail packs must be made in full at the time of purchase unless otherwise agreed in writing. We accept payment methods as indicated during the booking process. All transactions are processed securely through our designated payment providers.
4.3 Walk Credits and Membership
Trail packs grant a specified number of walk credits or unlimited access for a defined period as described on the product page. Walk credits are non-transferable unless explicitly stated. Unused credits from the Sunrise Starter Pass expire at the end of the calendar month in which they were issued. Coastal Circuit Bundle credits are valid for ninety days from purchase. Annual Dawn Membership is valid for twelve months from the activation date.
5. Walk Participation
5.1 Registration
To join a morning walk group, you must register in advance using your trail pack credits or membership. Registration confirms your spot subject to availability. We reserve the right to limit group sizes to maintain safety and quality of experience.
5.2 Meeting Points and Timing
Walkers must arrive at the designated meeting point at least fifteen minutes before the scheduled departure time. Route briefing details, including meeting points and sunrise times, are sent via email the evening before each walk. Detoxvivoneck is not responsible for walkers who arrive late and miss the group departure.
5.3 Walker Responsibilities
By participating in a morning walk group, you agree to:
- Wear appropriate footwear and weather-appropriate clothing
- Carry sufficient water for the duration of the walk
- Follow the guide's instructions and stay with the group at all times
- Inform your guide of any relevant health conditions or accessibility needs before the walk begins
- Behave respectfully toward guides, fellow walkers, and members of the public
- Notify us if you cannot attend a registered walk so your spot may be offered to another walker
5.4 Assumption of Risk
Outdoor walking activities involve inherent risks including uneven terrain, weather changes, wildlife encounters, and physical exertion. By participating in a Detoxvivoneck morning walk group, you acknowledge these risks and agree that you participate voluntarily and at your own risk. Our guides take reasonable precautions to ensure walker safety, but we cannot eliminate all risks associated with outdoor activity.
6. Cancellations and Weather
Detoxvivoneck may cancel or modify a scheduled walk due to severe weather, hazardous trail conditions, or other safety concerns. In such cases, walkers will be notified as early as possible and walk credits will be restored to their trail pack account. Walkers who cancel their registration more than twelve hours before the scheduled walk may have their credit restored at our discretion. Cancellations within twelve hours of the walk may result in forfeiture of the walk credit.
7. Intellectual Property
All content on detoxvivoneck.world, including text, graphics, route maps, logos, photographs, and software, is the property of Detoxvivoneck or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent. The Detoxvivoneck name and branding may not be used in connection with any product or service that is not ours.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Detoxvivoneck and its directors, employees, guides, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim arising from a trail pack purchase or walk participation shall not exceed the amount you paid for the relevant trail pack in the twelve months preceding the claim. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or under the Australian Consumer Law.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services supplied within a reasonable time if they fail to meet consumer guarantees. These rights are in addition to any remedies available under our Return Policy.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in connection with morning walk group services and trail pack purchases.
11. Governing Law
These Terms of Use are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to Terms
